Thank you for being part of our community. These Terms of Use (“Terms”) govern your access to and use of the TrekMeet website, mobile applications, and services (collectively, the “Service”). The Service is provided by TrekMeet Pty Ltd (ABN 96 701 247 145) (“TrekMeet”, “we”, “us”). By creating an account or using our Service, you agree to be bound by these Terms.
1. Our Service
TrekMeet is a platform designed to help you discover outdoor events, connect with fellow enthusiasts, and organise your own adventures. We provide the tools for connection; the adventure itself is yours to create.
2. Your Account
You are responsible for safeguarding your account and for all activities that occur under it. When you create your profile, you agree to provide information that is accurate and complete. You must be at least 18 years of age to use TrekMeet.
3. Community Conduct & Content
TrekMeet is a community built on respect, safety, and a shared love for the outdoors. By using our Service, you agree not to:
- Post any content that is unlawful, abusive, harassing, defamatory, or obscene.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Use the platform for commercial solicitation without our prior consent.
- Share private information about another person without their permission.
- Organise or participate in any activity that is knowingly unsafe or violates local laws and regulations.
We reserve the right to remove any content or terminate any account that violates these community standards.
‘Community standards’ in these Terms means the TrekMeet Community Guidelines published at trekmeet.com/community-guidelines, as updated from time to time. New groups may be reviewed against the Community Guidelines before they become visible to other members.
4. Safety and Assumption of Risk
This is crucial. Outdoor activities, including but not limited to hiking, trail running, and camping, carry inherent risks of injury, illness, property damage, and even death.
- You are responsible for your own safety. You are responsible for researching your destination, understanding the risks, bringing the appropriate gear, and assessing your own physical ability to participate safely.
- Organisers are independent. Event organisers are not employees or agents of TrekMeet. They are members of the community, just like you.
- TrekMeet does not monitor treks and does not dispatch emergency services. SOS places calls and shares links from your phone. In an emergency, call 000.
By using TrekMeet, you acknowledge these risks and agree that you are voluntarily participating in these activities. To the maximum extent permitted by law, you release TrekMeet from claims, liabilities, and losses arising from your participation in any event organised through the Service by other members.
5. Content Ownership and License
You own your content. You retain all rights to the photos, comments, and other content you post on TrekMeet.
You grant us a license. By posting content, you grant TrekMeet a non-exclusive, worldwide, royalty-free license to use, host, display, and distribute your content as necessary to operate and promote the Service. This allows us, for example, to show your profile picture or display your event photos within the app.
6. Payments and Subscriptions
TrekMeet may offer free and paid subscription tiers for members and organisers. Any fees for such services will be clearly disclosed before purchase. Some organisers may also charge fees for their events or accept donations through our platform. TrekMeet is not responsible for any financial transactions between members and organisers conducted outside of our designated payment system.
7. Termination
You are free to stop using our Service at any time. We reserve the right to suspend or terminate your account if you are found to be in breach of these Terms.
8. Disclaimer of Warranties & Limitation of Liability
The Service is provided on an “as is” basis. While we strive to build the best platform possible, TrekMeet makes no warranties regarding the reliability, availability, or accuracy of the Service. To the fullest extent permitted by law, TrekMeet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted, or modified. Where liability can lawfully be limited, TrekMeet’s liability is limited, at its option, to resupplying the relevant service or paying the cost of resupply.
9. Governing Law
These Terms shall be governed by the laws of New South Wales, Australia, without regard to its conflict of law provisions.
